If kicking that candle into a pile of dry leaves happened to start a fire, then the police would've blame the protestors for rioting and used it to as justification further crack down on the community.

Anytime this happens, they should vacate any conviction of property destruction/rioting/disorderly conduct and related charges. Why? Same reason as the 4th Amendment “fruit of the poisoned tree” doctrine.

And every law enforcement response to protest should be publicly examined via subpoena in this way.
