Here's at least one state where misrepresenting something as a controlled substance then selling it is punishable even what was actually sold is unregulated
America, not even once.
How could they prove that he was selling it? Listen in reality what would happen if this actually happened was the cops get mad at whichever administrator called them for wasting their time.
It's kinda obvious that one of his customers got caught and flipped. That would be proof enough for expulsion at least.
