I mean they're just doing what nintendo tells them to. I place most of the blame on Nintendo (leadership) itself.

Every company is like this. Maybe not to the same degree, but to some degree
Lawyers could just all agree not to do it and then the companies couldn't do anything but accept it. What are they gonna do? Not hire lawyers?
