The discussions appeared to be an effort by the Trump administration to window dress the underlying legal case and build a paper trail it could reference

It's going so badly that even after building a fake paper trail they still need to invoke the state secrets privilege...

Dont they have to prove that to the judge on the case? I thought the USA law accounted for this kinda thing, but I could be way off as I am not super versed in their laws on state secrets law.
