Worth a shot in the current climate - holding a monopoly could be a form of expression of free speech given how US law works.

Because lawyers are lazy and it was easier to define corporations as people than to say “corporations can sue and be sued but are not people. Besides, no one would ever be so stupid as to take it this far…”
