This is one of the few Musk situations where it may not quite be as black and white as it appears. I haven't looked deeply into this particular issue to see what positions are in question.
Depending on the jobs in question at least, many at SpaceX have ITAR restrictions. Some immigrants can qualify despite those restrictions, some can't. The process is a lot more complicated to verify eligibility, and more to actually get approvals. You could have a native candidate hired and trained before even verifying eligibility and approval in some cases.
That's why you do the fucking investigation. Because whatever Elon says is a lie based on everything I've ever heard in public, you need to actually verify what's happening and if it violates employment rules, tell them to stop, fine them until they do, and start looking at more severe penalties when they continue to not comply. None of this soft touch bullshit when defending people who have no power against a billionaire.
