!nostupidquestions is a community dedicated to being helpful and answering each others' questions on various topics.

The rules for posting and commenting, besides the rules defined here for lemmy.world, are as follows:

As long as the fascists are in power, they are functionally above the law. We've seen them murder in broad daylight and rape without punishment.

Rape by law enforcement is not at all a new problem. Now with even less oversight, encouragement to be "aggressive", a blitzkrieg method of deploying & hiring, and people being deported & disappeared... Civil rights are on the back-burner

The real answer is we don't know. Precedent doesn't exist anymore. The SCotUS has been ignored on 9-0 decisions. I'd broadcast: shoot ICE on sight; but I haven't gotten the opportunity, and truthfully I can't say what I would do in the moment.

You could be in the right. You could be legally correct. You could even survive. But who is there to enforce the law? Where are the consequences?

ICE is not above the law but when the people charged with upholding the law and investigating abuses are the ones encouraging it, what can you do?

Calling them fascists and authoritarians didn’t come from nowhere

Your civil state laws are still intact depending on the state, but a lot of this is the logical extremist conclusion of the patriot act and qualified immunity precedence, which is to say police have been elevated to a degree higher than that of a citizen with less responsibility than a citizen at the same time. Lazy politicians love the executive and we've had nothing but lazy majority politicians for a long time. It will not be easy to purge everyone that needs to go in order to fix this shitpile.

To more directly answer your question: Your rights depend on your actions and the system makes it very hard for you and very easy for them to create a situation that benefits you. You technically have a lot of rights, but if used would result in death with little accountability because court survivor bias. The answer mostly is to make sure you survive while asserting your rights on video, then follow up in court to take a chunk of their massive budget for stuff like this. You will likely win only if you do everything right and have video and audio evidence of doing so.

Non-uniformed police that don't identify are not police.

As such you can call (uniformed) police on them.

If they say they know that ICE are operating in that area, ask how you can know that the people you're reporting are actually ICE and not impostors that turned up after the real ICE left.

For those with no personal morals, limits to action are only enforced by consequences.

In the US, there are currently no consequences for immoral or criminal activity by the government in power or their minions (e.g. ICE). Thus, the only limit to their actions is their own morality; and they have been actively encouraging/recruiting support from those with absolutely no moral compass.

So no, there are no limits until consequences stsrt happening.
