A poor idea or poor execution? Seems to me from a marketing perspective, the Venn diagram of these two would overlap fairly well.

I think they have it labeled that way, because he plans on appealing, so it's possible that the verdict isn't final. But yeah generally once you've been given a conviction the terminology changes

It's probably because its a civil trial, not a criminal one. So he hasn't been 'convicted' - although personally it's more than enough evidence for me
